Environmental Due Diligence on Raw Land: Phase I, Phase II, and What to Look For

Environmental issues are the fastest way a raw land deal turns from profitable to catastrophic. We learned this in 2023 when we bought a ten-acre parcel in rural Georgia that we thought was clean vacant land, only to discover an old fuel tank burial site during site clearing. The remediation cost ate two-thirds of our margin on that deal. Since then, we have run environmental due diligence on every raw land acquisition before closing, and we have developed a tiered approach that keeps costs proportionate to risk.

Why Raw Land Environmental Risk Is Different From Improved Property

Improved properties come with disclosures, inspection contingencies, and lenders who require environmental reports as a condition of financing. Raw land comes with none of that. The seller has little incentive to disclose historic uses, and county records often do not capture the full history of a rural property. A parcel that looks like pristine pasture may have been a filling station, a dry cleaning operation, or a dumping ground for farm chemicals in the 1960s. Without systematic investigation, you are buying blind.

The stakes are also different for raw land. An environmental issue on a house can often be remediated without destroying the underlying asset. An environmental issue on raw land can make the land undevelopable, unsellable, and legally liable for decades. We budget one to three percent of purchase price for environmental due diligence on every deal.

Phase I Environmental Site Assessment

A Phase I Environmental Site Assessment is a records review and visual inspection. It does not involve physical sampling. The environmental professional reviews federal, state, and county records for known contamination sites within a specified radius of the property. They check aerial photography history, fire insurance maps, and tax records for historic land uses. They inspect the property surface for visible contamination, stressed vegetation, staining, or buried debris.

A Phase I costs between eight hundred and fifteen hundred dollars depending on property size and location. If the Phase I comes back with Recognized Environmental Conditions, that triggers a Phase II. If it comes back clean, you have documentation that you conducted due diligence, which matters for future liability protection.

Phase II Environmental Sampling

Phase II involves physical sampling of soil, groundwater, or building materials if structures are present. A typical Phase II on raw land includes soil borings at suspected contamination areas, groundwater sampling from any existing wells, and laboratory analysis for petroleum hydrocarbons, heavy metals, and volatile organic compounds. Phase II costs range from three thousand to twenty thousand dollars depending on the number of samples and the analytes tested.

Phase II is not always necessary on raw land. We commission it when the Phase I shows historical agricultural chemical use, when the property is near a known contaminated site, when visual inspection reveals suspicious fills or staining, or when the county records suggest prior industrial or commercial use.

Wetlands and Waters of the United States

Wetlands delineation is a separate environmental issue that affects raw land development potential. The Clean Water Act gives federal jurisdiction over wetlands and waters of the United States. A parcel with wetlands may be undevelopable without a Section 404 permit from the Army Corps of Engineers, which can take six months to two years to obtain and may be denied.

We use the Army Corps of Engineers wetland delineation manual and conduct a preliminary wetland assessment before purchasing any parcel that will be developed or subdivided. The assessment involves examining soil types, hydrology indicators, and vegetation. If wetlands are present, we measure their boundaries and assess what percentage of the parcel they occupy. A parcel that is fifty percent wetlands is not the same value as a parcel that is five percent wetlands.

Common Environmental Issues by Region

In the Southeast, old orchard sites frequently have arsenic and lead contamination from historical pesticide application. In the Midwest, former grain elevator and farm supply sites often have petroleum hydrocarbon contamination from fuel storage. In the West, former mining operations and mill sites can have heavy metal contamination that extends beyond the original footprint. In Louisiana and Texas, old oil and gas field infrastructure sometimes leaves soil contamination that requires state-level remediation programs.

Always check the state environmental agency database for the county where the property is located. Most states maintain a public database of known contaminated sites. If the parcel is adjacent to or near a listed site, your Phase I should investigate the potential for migration of contamination onto your property.

What Environmental Issues Mean for Land Value

Environmental contamination reduces land value in proportion to remediation cost and development restriction. A parcel with petroleum contamination in the soil might be remediated for thirty thousand dollars and retain full value afterward. A parcel with chlorinated solvent contamination in groundwater may require ongoing monitoring and institutional controls that make financing difficult and buyer pools small. A parcel with extensive wetlands may never be developable beyond its current agricultural use.

When we factor environmental risk into offer price, we estimate the worst-case remediation cost and discount accordingly. We never assume the best case. We have learned that lesson the hard way.
